Misdemeanor Expungement Attorneys in California

Under California law, a misdemeanor is a criminal offense punishable by up to one year in county jail, a $1,000 fine, or both. Common misdemeanor offenses include:

  • DUI without injury (Vehicle Code §23152)
  • Theft and petty theft (Penal Code §484)
  • Battery (Penal Code §242)
  • Domestic violence (Penal Code §243(e), §273.5)
  • Drunk in public (Penal Code §647(f))
  • Disturbing the peace (Penal Code §415)

Most misdemeanors are eligible for expungement—but relief is not automatic. You must petition the court under California Penal Code §1203.4 to request dismissal of the conviction. If granted, the case is reopened, the plea is withdrawn, and the conviction is dismissed.

Eligibility Requirements

  • All court-imposed conditions (fines, classes, restitution) must be completed
  • You must have completed probation, even informal probation
  • You are not currently facing new criminal charges or serving another sentence

There is generally no waiting period to apply for expungement once probation is completed. If your conviction did not include probation, you must wait at least 12 months from the conviction date before filing your petition.
