Most misdemeanors are eligible for expungement—but relief is not automatic. You must petition the court under California Penal Code §1203.4 to request dismissal of the conviction. If granted, the case is reopened, the plea is withdrawn, and the conviction is dismissed.
There is generally no waiting period to apply for expungement once probation is completed. If your conviction did not include probation, you must wait at least 12 months from the conviction date before filing your petition.
